These Terms & Conditions apply to the CCM DASH subscription service provided by A E DU CHENNE ENTERPRISES (PTY) LTD trading as CCM (“CCM”, “we”, “us” or “our”).

By subscribing to CCM DASH, you (“the Customer”) confirm that you have read, understood and agreed to these Terms & Conditions.

1. CCM DASH SUBSCRIPTION SERVICE

CCM DASH is a residential service subscription that provides Customers with a predetermined number of selected CCM cleaning and pest control services during a 12-month service allocation period.

Customers may select one of the available DASH packages and choose to pay either:

The services available to the Customer depend on the package selected at the time of subscription.

Annual subscription pricing includes the equivalent of one month free compared with paying the applicable monthly subscription fee for 12 months.

3. ELIGIBILITY AND SERVICE AREA

CCM DASH is available for residential properties within CCM’s applicable service regions.

The service is intended for residential properties including:

CCM DASH does not apply to:

CCM reserves the right to confirm that a property falls within the applicable residential and geographic service criteria before providing a DASH service.

4. SUBSCRIPTION COMMENCEMENT

The Customer’s subscription commences once:

  1. The Customer has completed the online subscription process;

  2. The Customer has accepted these Terms & Conditions; and

  3. The first payment has been successfully processed.

The date on which the subscription is successfully activated will be regarded as the Customer’s Subscription Start Date.

The Customer’s service allocation will be valid for a 12-month period calculated from the Subscription Start Date.

5. MONTHLY PAYMENT OPTION

Customers who select monthly payment will be charged the applicable monthly subscription fee for their selected DASH package.

The first payment will be processed immediately upon signup.

Thereafter, recurring payments will be processed monthly based on the Customer’s Subscription Start Date.

For example, where a subscription commences on the 15th of the month, subsequent payments will ordinarily be processed on or around the 15th of each following month.

The monthly option refers to the frequency of payment and does not change the intended subscription term.

The subscription remains subject to the cancellation provisions contained in these Terms & Conditions and applicable South African consumer protection legislation.

6. ANNUAL PAYMENT OPTION

Customers selecting annual payment will pay the full applicable annual subscription fee when signing up.

The payment covers the Customer’s applicable 12-month subscription and service allocation period.

At the beginning of each new fixed subscription period expressly agreed to by the Customer, a new allocation of services will be made available according to the Customer’s selected DASH package.

7. RECURRING PAYMENT AUTHORISATION

By subscribing to CCM DASH, the Customer authorises CCM and its appointed payment service provider to process the applicable subscription payments according to the payment frequency selected by the Customer.

Recurring online payments will be processed securely through Payfast.

The Customer is responsible for ensuring that their payment information remains valid and that sufficient funds or credit are available when payment becomes due.

Payment information is processed through the applicable secure payment gateway.

8. SUBSCRIPTION TERM

CCM DASH is offered as a subscription service with an intended minimum commitment period of six (6) months from the Customer’s Subscription Start Date.

Nothing in these Terms & Conditions is intended to limit or exclude any cancellation right available to the Customer under the Consumer Protection Act 68 of 2008 (“CPA”) or other applicable South African law.

Where Section 14 of the CPA applies, the Customer may cancel a fixed-term subscription at any time by providing CCM with 20 business days’ notice in writing or another recorded manner, subject to amounts lawfully owing up to the date of cancellation and any reasonable cancellation penalty permitted under applicable law.

Selecting the monthly payment option refers to the Customer’s payment frequency and does not alter the intended subscription commitment.

9. CANCELLATION REQUEST PROCESS

Customers wishing to cancel their CCM DASH subscription must submit a CCM DASH Cancellation Request through the CCM website or another written or recorded channel accepted by CCM.

The Customer will be required to provide sufficient information for CCM to identify and process the subscription cancellation.

Once the cancellation request has been received:

  1. CCM Head Office will acknowledge receipt of the request.

  2. A CCM Head Office representative will contact the Customer regarding the cancellation.

  3. CCM will confirm the applicable cancellation date.

  4. CCM will calculate any amounts lawfully outstanding up to the cancellation date.

  5. Where applicable, CCM will calculate a reasonable cancellation penalty permitted under applicable consumer protection legislation.

  6. CCM will communicate the final amount payable, if any, to the Customer.

  7. Once the cancellation takes effect, future recurring subscription payments will be stopped.

Submission of a cancellation request does not affect any amounts that became lawfully due before the effective cancellation date.

10. EARLY CANCELLATION AND CANCELLATION PENALTY

Where a Customer cancels a fixed-term CCM DASH subscription before the end of its intended subscription term, CCM reserves the right to impose a reasonable cancellation penalty, where permitted by the CPA and applicable regulations.

The cancellation penalty will not automatically be equal to all subscription payments that would otherwise have become payable for the remainder of the subscription term.

When determining a reasonable cancellation amount, CCM will take into account the circumstances relevant to the Customer’s subscription and the requirements of applicable consumer protection legislation.

This may include, where applicable:

CCM Head Office will calculate and communicate the applicable cancellation amount to the Customer as part of the cancellation process.

Nothing in this clause limits any right available to the Customer under the Consumer Protection Act or other applicable law.

11. UNUSED SERVICES FOLLOWING CANCELLATION

Once a subscription has been cancelled, the Customer’s entitlement to future DASH services will end on the effective termination date, subject to applicable law.

The treatment of unused service allocations, amounts already paid, credits or refunds will be determined in accordance with these Terms & Conditions and applicable consumer protection legislation.

12. SERVICE ALLOCATION AND EXPIRY

The services included in each DASH package are allocated for a 12-month service period commencing from the Customer’s Subscription Start Date.

Customers are responsible for making use of their allocated services within the applicable 12-month period.

Any services not used within that period will expire, subject to applicable law.

Unused services do not ordinarily roll over into the following subscription year.

At the commencement of a new fixed subscription period expressly agreed to by the Customer, a new allocation of services will be provided according to the applicable DASH package.

13. BOOKING DASH SERVICES

DASH subscription services are arranged directly through CCM.

Following successful signup, a CCM consultant will contact the Customer to welcome them to DASH and assist with the scheduling of their included services.

All service bookings are subject to:

Customers are encouraged to schedule their allocated services sufficiently in advance to ensure that they are used before the end of their applicable service allocation period.

Customers must provide CCM with at least 24 hours’ notice if they wish to cancel or postpone a booked DASH service. If the Customer fails to cancel or postpone the booking at least 24 hours before the scheduled service time, the service will be treated as used and the applicable service credit will be forfeited.

14. CARPET CLEANING and PEST CONTROL

Where carpet cleaning is included in a DASH package, the carpet cleaning method provided as part of the subscription is Hot Water Extraction.

Additional specialist treatments, stain treatments or services outside the scope of the applicable DASH package may be quoted separately where required.

Pest Control: For the purposes of CCM DASH, pest control means the treatment of insects inside the premises by means of a spraying application only. The service is intended for general crawling insects such as cockroaches and ants. The service excludes infestations, specialised fogging and/or fumigation, and the treatment of insects or pests requiring specialist treatment, including termites and borer beetles.

15. PACKAGE UPGRADES

Customers may request to upgrade their DASH package at any time.

Any difference in the subscription fee resulting from an upgrade will be communicated to the Customer.

The Customer’s subscription payment will be adjusted to reflect the upgraded package once the upgrade has been processed and confirmed by CCM.

Any changes to the Customer’s available service allocation resulting from the upgrade will be confirmed at the time the upgrade is processed.

16. PACKAGE DOWNGRADES

Customers may request to downgrade their DASH package for their next applicable subscription period.

The downgrade will not ordinarily take effect during the Customer’s current fixed subscription period.

The Customer should contact CCM before renewal if they wish to move to a lower DASH package.

17. FAILED OR DECLINED PAYMENTS

If a recurring subscription payment is declined or cannot be successfully processed, CCM may contact the Customer to arrange payment or request that the Customer update their payment information.

CCM reserves the right to suspend access to unused DASH services while subscription payments remain outstanding, subject to applicable law.

Failure to make payment does not automatically constitute cancellation of the subscription.

Where applicable, CCM will follow the notice requirements prescribed by South African consumer protection legislation before terminating a fixed-term agreement for material non-payment or other material breach.

18. SERVICE LIMITATIONS

CCM DASH packages cover only the services expressly stated as being included in the Customer’s selected package.

Services outside the package scope, specialist requirements, additional work or work outside the applicable residential service parameters may be quoted separately.

CCM reserves the right to assess whether a requested service falls within the scope of the DASH subscription before confirming the booking.

CCM DASH is intended for normal residential requirements and does not apply to commercial, corporate, hotel or lodge environments.

19. CUSTOMER RESPONSIBILITIES

21. PAYMENT SECURITY

Online subscription payments are processed through Payfast.

Payment information entered through the secure payment environment is handled by the applicable payment service provider.

CCM will take reasonable steps to ensure that subscription payments are processed using appropriate secure payment systems.

22. PERSONAL INFORMATION

CCM will process Customer personal information for purposes including:

Personal information will be processed in accordance with CCM’s Privacy Policy and applicable South African data protection legislation.

Where consent is required for marketing communications, this should be obtained separately from acceptance of the DASH subscription.

23. COMMUNICATION

The Customer agrees that CCM may contact them using the contact information supplied during signup for communications relating to their DASH subscription.

24. EXPIRY, CONTINUATION AND RENEWAL

CCM will provide the Customer with notice of the impending expiry of their fixed-term subscription within the period required by applicable consumer protection legislation.

Where Section 14 of the Consumer Protection Act applies, this notice will be provided not more than 80 and not less than 40 business days before the expiry date.

The notice will advise the Customer of:

At the end of the fixed term, where required by the CPA, the subscription will continue on a month-to-month basis, subject to any applicable changes communicated to the Customer, unless the Customer:

Where the Customer expressly elects to renew for a further fixed term, a new service allocation will apply in accordance with the DASH package selected for that renewal period.

25. CHANGES TO THE DASH SERVICE

CCM may from time to time amend the DASH service, package offerings, pricing or these Terms & Conditions where reasonably necessary.

Where a change materially affects an existing Customer’s subscription, CCM will provide appropriate notice before the change takes effect, subject to applicable law.

Changes to package pricing will not be applied retrospectively to payments already made.

26. REFUNDS AND CREDITS

Subscription fees already paid are not automatically refundable because a Customer has not used all of the services allocated to their DASH package.

Where a Customer cancels their subscription, any refund, credit or amount remaining the property of the Customer will be handled in accordance with applicable consumer protection legislation.

Where a payment has been processed incorrectly or in error, the Customer should contact CCM Head Office for assistance.

27. CUSTOMER SUPPORT

28. ACCEPTANCE OF TERMS

By selecting the acceptance checkbox and completing the CCM DASH subscription signup process, the Customer confirms that they:

Nothing in these Terms & Conditions is intended to waive, restrict or exclude any right afforded to the Customer by the Consumer Protection Act or other applicable South African law.

30. IMPORTANT SUBSCRIPTION NOTICE

Before completing a CCM DASH subscription, Customers should take note that:

CCM DASH is designed as a subscription service with an intended six-month minimum commitment. Where the Consumer Protection Act applies, Customers retain their statutory right to cancel a fixed-term agreement by providing 20 business days’ notice in writing or another recorded manner. Amounts lawfully owing up to the cancellation date remain payable and a reasonable cancellation penalty may apply where permitted by law.
